Being a dealer means you are bound by the carriers return policy, HOWEVER, there may have been an additional contract *usually* a 180 days contract, with the dealer who sold you the phone. This may be where you will be hit with a termination fee, not with ATT/Cingular. For ATT/Cingular they will just reopen your account when its cancelled and give you the new customer pricing on the phone, since you were within that 30 day window.
