I bought the phone from a 3rd party. In options it gives me "new user" and enter old user info. I don't have the old info and apparently I am not a new user either. How am I supposed to get this thing going??

Call the carrier and have them remove the pin from the old user...

Typically, if the original owner's BIS account is till active, you will need to have that person call his/her carrier and delete their BIS account, which will also release the PIN so you can set up your email and activate the device.

i find once you get the phone as long as the esn is clear. you can tell them that the phone was setup as a demo in the store.

at least worked for me. had the email rest on mine

I just called and told him its from a 3rd party...the guy reset the PIN and all was good go to in seconds.

did you called the vendor of the phone or the carrier itself?

i have similar issues as well, how do i go around this? do i contact my local carrier here in the philippines or should it be done with the sprint @<hidden> the US?
