Audio access violation

I have an app that plays audio files. I can easily play every audio file no problem until I try to play one that has already been played. When I do this it throws an "access violation" error. Am I supposed to release the mp3 file somehow or what.

After further testing it only does this on the 8350i. Thinking it may be a simulator problem I loaded it to my handheld but it does the same thing.
