for tracking SMS and e-mails, it still documents them an hour Behind. when i go to Options > Date/Time and click "update time" (regardless if it's on BB or Network) it will turn the clock back an hour. what is the deal?? my phone just wont comply with DST!

Just in case it is overlooked, verify the timezone.

Also

BlackBerry ...apply the patch. You shouldn't need it on that model and software version as everything 4.2 and newer has it, but it really sounds like that is what it is.

What software version are you running? even thought the 4.XX series OS's have the DST already coded in, you should make sure you have the newest which is the .97 release. Once that is installed it should rectify the problem you are having.
