Default Unlock blackberry, illegal on AT&T network

I have a question, I heard from a AT&T representative that using a unlocked blackberry without their data plan is illegal and that they can back charge you for the entire time that you have been using the phone. I don't have any interest in using any of the data plans I just enjoy the way that it is setup for calling and texting, mainly the texting. I this actually true or was that representative of AT&T just trying to scare me into getting their data plan?

No, any blackberry (unlocked or at&t branded) requires a Blackberry data plan on at&t.
If you dont have one on your account, they will eventually add it.

The charging for past use is a new one, though wouldn't surprise me.

ATT periodically scans accts to ensure that features match the devices in use! Have a BB or iPhone or any other data device and lack the appropriate feature they will add it

Never heard of back dating it though
