Call someone on the the phone book if it has no pass code. Other then that i have no clue on how you would return it. I have a return number and will give reward on my screen lock screen.
to answer your question its not true. as long as its a GSM phone you can slide a new Sim card in it and it will work as a phone. Now as a blackberry it might not. Sometimes the address and Pin of the pass customer is still in RIM's system and it wont allow you to choose a new email or join under a new account.
but having in mind that i'm NOT GOING TO DO SO.. can u answer if what i asked is true?

Man I hope karma comes around to people like you. How would you feel if you lost a $400 object, and someone found it, in tact, and had the means to find out how to get it back to you, but instead said "Finders keepers bud, your SOL."
So what are you going to do if the person who owns it has GPS tracking software installed and comes to collect and asks you why you didn't call the phone company to get it back to him?
I found a Blackberry one time, and this worked for me:
1- Fully charge the Berry (or, at least over half-way)
2- Power it on....let it cycle through its boot-up session
3- Turn power off
3- Place device face-down in a pan with 1/4" of water
4- After 30-45 seconds (NOT 1 MINUTE+) Pull it out
5- Immediately Power it on again
If it doesn't work the first time, repeat steps 3-5
