i wonder if that is the case, and they want the device back if RIM pays him for it as he has already paid for the device...

If RIM does want it back, they probably have some kind of legal right to get it back without compensation. Kind of like when someone buys a stolen painting and the original owner finds out. They get it back, no compensation given to the previous buyer.

yes, but it doesn't say property of Research in Motion anywhere on it... so prove that its theirs.... that's why i was wondering... its weird to see a device like that without that sticker or warning upon booting up...

Weird that a non-released model even gets out into the market. I'd be pretty certain they will know by the ESN what RIM employee was trusted with this device.

I would NEVER sell a RIM pre-release on Ebay, especially known what's happened to people who have tried that before.

I hope you're not a RIM employee because whomever took that phone WILL be found out, and the punishment is not fun.
