Is it scratched? Is the PIN still active on someone else's account?

That's about the only way to tell. Where did you get it from?

well fairly obviously, if you buy from a phone company, its new, if you buy from ebay, look for brand New In Box/Sealed, and make sure their are pics to back that up, then its usually new.

as far as i know, there isnt a way to tell if the phone is used, on the actual phone. unless its scratched/got previous users files on it etc.
