Default Is this legal?

Yeterday I went into a "VERIZON" retail store in Fort Myers, FL to buy the Storm. They had 3 in stock. I was told that the only way they would sell me the phone (I already have an 8830 and am entitled to the upgrade deal) is if I took out a $99.00 insurance policy on the Storm, which is a waste of money in my opinion!

I walked out!!

not sure if its legal but definitely not ethical, i agree call corp and complain and use specifics - people involved if possible.

I wouldn't necessarily consider that "illegal" How many times have you seen offers for a free drink ***with the purchase of a meal*** coupons? Similar situation. Get the phone but you got to purchase something else to get a discount. Granted with insurance that is almost always optional (minus motor vehicles).

I know that calling it insurance is illegal. There are laws and regulations that require it to be called a replacement program and not insurance. Other then that I thinks it just bad business practice. I would go through customer care anyway. They have more power for price negotiations then the salesmen do.

Illegal or not - it has to be against store policy or corporate policy.

No matter how bad I wanted a Storm, I would dump that carrier/provider so fast for a BS stunt like that.

Why would you punish the carrier?
This looks like greedy sales person/manager, and not corporate policy.

Sure, that makes sense. But Verizon corporate (their district managers, regional managers, etc) should be ensuring that stores do not operate that way. There should be some accountability.

This is more of a general comment, but the reason that stores pull stunts like that and get away with it, is because we keep giving them our business.

That is just me though. I have a low tolerance for things like that.

I smell a Bait -n- switch. Unless this was advertised, and/or the norm at all locations, someone's trying to make a buck. Speaking of which.... 20 bucks says the policy would never be written.

I would say illegal. That's like the car dealerships that say it's "required" that you buy an extended warranty for the bank to finance you.

Sounds to me like you went to a Verizon wireless authorized dealer and not a corporate store. Verizon never makes you purchase insurance, in fact they offer it as an option for $5 a month and if you say no, it isn't a big deal at all. I do not know of a $99 insurance or replacement plan with Verizon. Sounds third party to me, and yes it's illegal! Contact your local BBB or the Federal Trade Commission, I would also notify Verizon .. It is likely that Verizon will try and make it right for you.

After you call the BBB, call Best Buy. They are receiving shipments in our area, but the Verizon stores are not until all the outstanding orders are filled.

I agree, my local Verizon store was great. I went in to purchase a Storm the day of release but they were out, so they gave me the $50 rebate off up front and over-nighted me the phone. I had a great experience with them. They did offer the warranty, but I said no and they didn't question me further.
