I just replaced my 3.6 BES (small business 15 lic) with a NEW 4.0 (20 user) BES (Enterprise). My question is this What can I do with the old software?

Can I sell it on ebay or craigslist without going to jail (LOL)

You should either read your EULA or contact Blackberry to be sure. IMHO I would think you could transfer the license if you purchased a full install copy of 4.0 and not an upgrade. Generally when you purchase an upgrade part of the deal is that you remove the old copy and not use it or resell it.
