I did a bit of research on these forums and i couldnt find the answer ot my problem.
I turned data while roaming to off but now while im roaming i am still able to send and receive emails.
I have no wifi access.
is my phone defective?

if I turn all data service to off then I cant use data at all. which would be fine if I didn't have to enable and disable data every day I go to work . I live outside of the so called " home zone".
any suggestions?
BTW i am using a BB9700 on Mobilicity network Canada

may be you are not on roaming, you will have to check with your provider or your plan.unless you have WiFi enabled and it goes to WiFi connection you should not be receiving emails or data.
I dont think its a defective device it has to do with your plan
