In a blow to Arlington-based NTP Inc., the U.S. Patent
and Trademark Office (PTO) on Wednesday issued its fifth rejection of a
patent held by NTP. The Virginia-based company has been involved in a
patent infringement suit with BlackBerry maker Research In Motion (RIM).
The move means that the PTO now has rejected all five of NTP's patents that
it has been using it its battle against RIM, whose stock gained 8% on the
news. NTP said that it plans to appeal the decision. The news comes three
weeks before a federal judge is expected to hear a motion for an injunction
that would at least temporarily shutter BlackBerry's service in much of the
U.S. Analysts, however, believe that the latest patent decision would make
such a move unlikely.
