When you do a warranty exchange you agree that if the device has been dropped in water, opened or othrwise messed with then the warranty is void and they charge you for the device. You agree to this then ship it to them after you receive the new device. They have a department that goes over the returned items and I imagine they have a way to see if it has been opened (broken seal etc). It is not like the guy at the store or on the phone has the final say.
I returned a Nokia this way that had been water damaged, they saw that and charged me for the replacement ( at a lower cost than new ). You agree to the terms beforehand and it is up to them to determine fault or in/out of warranty.
Anyway, they have a pretty strong return / warranty system. How they would actually know I am not sure, but they would definately check.
