All recent phones have tracking via their built in GPS. Try and buy a phone without it. Try finding a way of turning it off. All landline switches have government required phone bug functions. This started way before 911.

pretty sure android can be turned off... when i first boot a clean rom, i get a check box to check to allow google to collect stuff. i just uncheck it. i tried to pull from my droid the gps locations and it has none....

wabbit, i seriously doubt you can turn off the government mandated gps tracking on any modern phone. Generally the "off" position only prevents you from getting access.

heres more info on google

Google: Android location tracking is opt-in | BGR

and some on apple. which only apple discolses this info in the eula

Apple: We 'must have' comprehensive user location data on you - International Business Times

so you can opt into one of the two.
