Default Fumes out of ears - 11-15-2008, 03:26 PM

Well the wife and I "finally" found a place to move that was big enough and affordable. We went and looked at it gave the lady our info, she called the next day and said everything checked out...we could move in on the 1st of December. Well we get an e-mail from her last night stating that she has leased this property out to a friend for 6 months and that if we were still interested she would let us move in when her friend moved out...

Well this to me is a little f***ed up...I couldn't believe she had the nerve to think we would ever want to do business with her ever again...is it just me or is this acceptable?

That is a really cheap thing to do. Had you already signed the lease to move in?

I'm assuming not, since it would have been highly illegal for her to do that if you'd already signed a lease.

Right nothing had been signed we were supposed to meet w/ her Monday to sign everything, but she had already run all of our information through whatever channels they go through and said we were good to go.

someomes word doesn't mean squat these days!

That's why I always believe, get it on paper!

Legal standpoint, you got nothing, and you are owed nothing, she can do whatever she wants.

But her as a person, that's kinda a crappy thing to do, consider all the time you prob invested and consider possible other properties that you looked at and pulled out only believing you got this one. But consider this a future lesson, nothing is final until its all on paper! Just don't get your hopes up so soon!

I'd be ticked not only that she broke her word but that (it sounds like) she ran a credit check and then did nothing with it. You'll have to get another credit check run at the next place you find, too.

Seems like I heard somewhere that having too many credit checks run in a short amount of time can actually raise a red flag.

For the owner, six mos is not a good deal unless the money was too good to refuse. I would think with the economy you would have some flexibility in your choice in that there would be a glut of places to choose from. I am sorry for your grief.

Is she a realtor or the property manager? I am out of my element when it comes to realty, but I would think that violates professional standards by both her company and whatevery governing body she belongs to. I would certainly report her to her boss/company.

Yeah -- that's not a very nice thing to do. If that person works for some real estate company, make sure his/her boss knows about it and never do business with them again.

But lesson learned: Get stuff in writing!

I suspect that he had talked to the owner of the property who was leasing it without an agent's representation.

I agree with the other, a really rotten thing to do...

Sieze the moral high ground-if you are still in the market in six months, she'll no doubt be calling you-ask her how much she'll be discounting the rent for the pain and inconvenience she caused you now.

She owns 2 houses and leases them out. I still haven't replied to the e-mail to try and avoid saying something out of anger...I may just not reply at all.

That's really terrible. No morals or ethics on her part. I would not do business with her again. When you get past the initial anger, I'd send her an email telling her what you think of what she did, just be professional about it.

I decided not to send an e-mail, there was no way to me to be professional about it lol so I just left it alone.
Good news is that we found another place and are waiting for approval.
