Default Is it unlocked or not? Pre-Owned 7230...

So I bought the 7230 off of ebay, where the seller CLEARLY states that it's unlocked and will work with any carrier. Upon turning it on, it has t-mobile software and will recognize my Husband's SIM card and phone number, but is acting funky and not able to receive calls, etc. However, it is NOT refusing the SIM card.

So does this sound like it might NOT be unlocked after all?

I tried to upgrade the software with the newer "Cingular"(at&t) software, and it upgraded it but kept it as t-mobile.

Any insight?

It will always show a T-Mobile logo. To check lock status:
