looks like it was a combination of two things messing me up, one I was settings some headers, that as pointed out by David O'Meara gets mangled and also the APN looks like it is blackberry.net rather than the internet.com and vpn.com that is quoted in the Rogers developers documentation:

removing the headers setRequests and fixing the APN did the trick so now it is working on the device (a 7280 running 3.7.0.76).
now onto fixing that header issue . . .
