It's not COD controlled. Not entirely, because some COD files are coded for 105 ID triggers, but the major check and disable is in the Firmware file itself, not the OS. The firmware file is the sfi file. It's what gets executed when you see the RED LED on when you power the BB on. When the LED goes off the OS starts to boot. There's a 105 ID and 8830 model check that happens on Firmware execution which triggers a disable to API calls to the GPS chipset.
The phone status screen hows GPS as enabled because it is... for E911. It's the API calls that VZW has disabled. It's very possible that they have simply changed the memory address at which the varios API calls look for interaction with the GPS chipset. This alone would kill access to the chipset. Memory call relocation for instruction sets is a pretty easy thing to change at the firmware level.
