I have a 8700g (in Aus) and in the options menu when I click to downlaod a theme I am redirected to the website then an error message says
"downloads require BB devices running software version 4.1 or higher."

My BB is 4.1 what's the prob?

Set your default browser Configuration to Internet Browser in the Options/Advanced Options/Browser screen.
