Ok, this is a long story but I have run out of options. I sold a motorcycle 4 months ago and took a blackberry storm for a portion of the money. The phone had service and was working fine. I already had a phone, but I figured I would just sell it on ebay. I sold the phone on ebay and two months later the lady who bought said when she went to activate it there was an insurance claim on it and she wanted her money back. I had her ship me the phone back and I went to verison today and they took the back off the phone and told me the samething. I told them the situation and they basically said you are screwed out of $350.00 because there was nothing they could do.
Is there anyway possible to fix this or am I ****ed out of my money and a phone I cant use?
The guy who sold it to me is from out of state and I have no way of contacting him. Any help would be greatly appreciated!!!!!
I believe that you should talk to your friendly local police force -- or the police force in which the sale of the motorcycle took place -- but you are probably not going to have too much luck.
Sounds like you got hosed. File a police report in the jurisdiction that the sale took place. It sounds like intent to defraud, to me. You stand little chance of getting your money back, however ...
The only way I think something would happen is if the guy who traded the phone is also the one who claimed insurance on it. Then it would be insurance fraud. So try the insurer and see if they're interested.
If the people are different, I doubt anyone will do anything more than take a report, even if the phone were stolen. But you should go that route anyway since it'll be more likely to trip the guy up in the future if he does something similar again.
There's no way to free up the phone or something along those lines. The PIN and IMEI are specific to the phone. Even from another country, the services go through RIM.
