Yes, RIM is releasing beta OS after beta OS and Verizon is choosing not to make any of them official. So what?
Just like with any other purchase you make, if you don't like the product, you have the right to return it for a refund or exchange it.
Verizon is obviously aware of how many Storms are being returned, and they have the right to act in the best interest of their business. If the high rate of returns isn't a concern for them, they are not obligated to do anything about it.
The idea that people would actually demand a better product and better customer service through petition and threat of a class action law suit completely blows me away.
If you were forced to keep the phone, despite being unhappy with it, and Verizon was not providing you with the service you pay for, then perhaps you might have a case. Providing you with official OS upgrades is not part of their contractual obligation, though.
If you were to buy an HP printer at Best Buy that didn't meet your expectations, and then you found out the printer had very poor reviews, what would you do? Would you go back to Best Buy and demand that they do something to improve the product they sell but don't make, or would you return the stupid thing for a refund or a different printer?
You have options, and you make choices. Don't act otherwise.
