If this is in Class Action stage, things could become very interesting.
I remember researching and asking questions about the GPS capabilities while the phone was in late development. VZW reps at HoFo were grilled on GPS functionality. All pre-release signs posted to the GPS being open and unlocked. I'm sure the evidence will include the initial advertisements and spec sheets that did
not include the obligatory legal disclaimer

This should be game, set, and match, but either VZW will win or the customers will get a free keychain for their troubles while the lawyers rake in a massive amount of legal fees.
Like I said before, I'm happy with my phone and the gimped GPS really doesn't mess with me at all. I will be interested to see the outcome, though.
