INSPECTION
We can arrange inspection - just contact us and we will work out the details. Most items can be inspected anytime, but there may be cases where an item inspection will be limited to business hours M - F. Additionally, if you are unable to inspect in-person and require further information, we will make every effort to furnish you with any picture or video that you request. Please contact us.
INDUSTRIAL ITEMS - many of our heavy items (palletized/crated and/or over 150#) can be shipped via regional carriers and often significant savings are possible when shipping to the carriers most local FOB and then the BUYER can go pick the item up at that location. We have had good results at very reasonable rates using this method. Please let us know if you want us to include that option for you. Sometimes a short drive will equal hundreds of dollars in savings!
We will work with any buyer to make acceptable arrangements. We do not consider shipping/packing/palletizing/insurance costs as profit - they are a “pass-through” expense - the BUYER will pay what we pay.We will detail the expense as accurately as possible prior to completion of the sale. When you agree to purchase an item you are doing so with the full understanding that SHIPPING COSTS are additional and will be the responsibility of the BUYER, unless stated otherwise. We encourage you to contact us in advance of a sale so that we can clarify shipping costs and expectations. Your shipping costs are direct - we do not profit - some items are very heavy and will require extensive packing for freight - we will make every effort to find as economical arrangements as we can - these expenses are not something we control, we do not make money on shipping/packing.
Also, preparing your item for shipping is a VITAL part of doing business in the electronic age. It is important to us and you that your item arrive in the same condition it is in when it leaves our care. We will pack items in such a manner as to 1. Achieve the goal of your item arriving in the same condition it is in when we ship it and 2. Because of these two conditions of shipping prep there are expenses involved - and as noted above these costs are generally paid by the BUYER. We do make some allowances on the value of the time that it takes to prepare your item and that fee is often built-in to our prices. We price our items to sale as a BIN - in the case of a best offer, if given, the stated shipping prep fee’s may not then apply. While we’d like to sale our items it still takes what it takes to prepare them and some items require extensive prep (materials and time) and that expense is the BUYERS responsibility, unless agreed otherwise.
Unless otherwise stated - all shipping and packaging/palletizing costs are the responsibility of the BUYER. Direct delivery of some items may be possible depending on the item and the delivery location. We will ship your item as soon as possible, usually within 3 business days. We will advise you of any delay resulting from necessary special handling/packaging/palletizing/crating. We will also advise you of any delay in shipping based on the payment method. Once the item is released to the shipper the SELLER will notify the BUYER and will supply all available information and details including tracking numbers, if applicable.
TERMS AND LIMITATIONS
This item is sold \"as-is\" and we are not guaranteeing any period of operability beyond initial use. Items operability is warranted through Protection, however no definitive operational warranty period exists beyond item being in working order on receipt. Be advised that there are variables that may not be apparent or discoverable even during any inspection or testing process that we may do. Buyer should be aware that many of our items are mechanical and are recovered from industrial operations and unless noted otherwise, are reported to be in working condition. In some instances we may have direct knowledge as to the operability of an item and, if so, it will be stated directly and we will supply interested buyers with all information we have available - including inventory details, inspection and/or service reports that we may contract for after the item is added to our inventory. While we will make every issue we are aware of known and describe to the best of our ability the item/system - its condition/limitations - the seller makes no warranty that the item is acceptable, merchantable or fit for any purpose.
The buyer assumes all responsibility for the SAFE and LEGAL installation and SAFE and LEGAL use of this item and agrees to adhere to standard and prudent practices and will use the item in accordance with all local, state and national laws, regulations, codes and those of any applicable regulatory agency. The BUYER will research and be solely responsible to obtain all necessary that may be required to use/install/operate the item. The BUYER agrees that he/she understands that this item is for an industrial/mechanical/electrical application and either possess the skills necessary for operation of the item or will contract a professional for the installation and all subsequent use will be done by a qualified entity. If the item is for use in electrical, mechanical or industrial operations the BUYER acknowledges that he/she is aware these areas involve inherent risk and recognizes that serious injury or death may occur - even when all operations are conducted in any intended manner.
The BUYER further recognizes the risks associated and agrees and will assume all liability for any issue with the item once it is in his/her possession. The BUYER acknowledges that he/she may have to inspect/install/change any safety stop/release/guard, signage or other component to insure that the item will function as desired and in accordance with all ordinances, codes, regulations or insurance/industry standards related to the item and use.
The BUYER agrees to defend, indemnify and release the SELLER from and against any and all claims, suits, costs and legal expenses for any direct or indirect damage/equipment failure/service interruption or other failure that may arise from any use, intended or otherwise, that may result from any transport/installation/removal or operation of the item. By offer or by offer, the BUYER acknowledges and agrees with these terms.
NON -LIABILITY OF SELLER
Seller shall not be liable for its failure to perform hereunder due to any contingency beyond its reasonable control, including acts of God, fires, floods, wars, sabotage, accidents, labor disputes or shortages, government laws, regulations, ordinances or codes, inability to obtain material, material equipment or transportation and any similar or different contingencies. In no event, whether as a result of breach of contract or warranty or tort (including negligence), will Seller be liable for any incidental or consequential damages including, but not limited to, damages for loss of revenue, cost of capital, claims of customers for service interruptions or failure of supply, and costs and expenses incurred in connection with labor, overhead, transportation, installation or removal of products or substitute facilities or supply sources.
