Not a legal expert but..

What if NTP wins or get the government to shut down push service, can't we as consumers come up with a class action suit or something against them for infringing on our rights as a consumers. By denying push email service?

murpheous 12-14-2005 04:53 PM

don't worry about it

NJBlackBerry 12-14-2005 04:54 PM

Well, I agree with you on one point, you are not a legal expert.

Or is this one of the rights in the Bill of Rights that I missed..

Freedom of Speech
The Right to A Militia
The Right to Wireless E-Mail

WNO 12-14-2005 05:51 PM

Lol, NJBB! Yes, if that right was indeed among those set forth in the Bill of Rights, I think all of the carriers would be bankrupt by now.

But buddapaw, gentle kidding aside, a shutdown wouldn't appear to be in NTP's interest, since w/o RIM's infrastructure and customer base, NTP's alleged intellectual property doesn't have all that much value, particularly with all of the competitors (with non-NTP systems) coming on board. So, as murpheous said, don't worry about it.

And no, barring any unfathomly bizzarre developments, there is no possibility of a class action suit based on NTP's enforcement action.

Thanks for the comments, as I said, I am not a legal expert. NJBB don't mess with me I'll double your income Tax

I doubt it will be an issue. NTP doesn't "win" if Blackberry services are shutdown in the US. They need RIM to continue to make money to win.

A class action suit would be worthless unless you want a $5 coupon as a settlement while the lawyers rake in the actual cash...

NJBlackBerry 12-14-2005 07:06 PM

Hey - I am already subject to the accursed AMT. How much more can you punish me?

Aroc 12-15-2005 04:21 PM

Oooh. A class action lawsuit. Great instead of a anything actually meaningful I get a $5 coupon and the lawyers get like $20 million. Let's do it!
