For what its worth, I have tried to recreate the issue on my 8310 running .42, and I have not received the error.
I have had format issues in the past with the camera (4.2) and the issue was actually with my media card and not my OS. I pulled the media card (and later formatted for other reasons), and when I tried the card again some time later, I had no issues.
