ok problem solved. i failed over bes services to standby server and tried to update and received same error, i then also failed over sql mirror to the sql standby server and this time the installation worked fine. so lesson learned, when updating bes server fail over both bes and sql if you are running it locally (perhaps this is also valid if you run sql on a separate server)
