I honestly don't see it. Most, if not all, of the senior staff of many fire departments depend on them.

I can't see RIM letting it come to that. I figure the if everything starts going badly for them they would pay up rather than risking a blackout and loss of sales for new devices.

Even if there was a blackout, NTP has already stated that first responders like fire/rescue departments would be exempt from it.

It's still $400 million regardless of how much you make, but NTP refused $450 and the media seems to think NTP wants $1B and everyone except them hopes they get $0.

I agree it never will happen though, worse case is RIM will impliment the workaround, and BB not capable of upgrading the software could go dead, if the government allows it to go that far.

I still don't think there is a true way to determine a "first respond" list. Sure RIM could easily exclude anyone that ends in .gov but I bet that only covers about 20% of the government employees and first respond people. After all a large part of Emergency personal are not government employees and the ones that are, may not have .gov addresses, especially on the local level.
