U.S. Patent Office Rejects Remaining NTP Patent
TORONTO -- The U.S. Patent and Trademark Office has rejected all claims in the remaining NTP Inc. patent that it is reviewing.
The patent is one of five at the heart of a protracted patent-dispute between NTP, a Virginia-patent concern and Research In Motion Ltd. (RIMM), maker of the BlackBerry email device.
The rejection, which the USPTO confirmed, is a non-final action - also commonly referred to as a first-office action - and can be challenged by NTP. The USPTO has now reviewed all five patents at issue in the RIM/NTP case and rejected all of the claims in all of the patents.
However, that is not unusual and doesn't mean the USPTO won't reverse its position on at least some of the thousands of claims at issue in future decisions. "It will be unusual in the end if they reject every claim in every patent," James Hurst, patent lawyer at Winston & Strawn LLP, told Dow Jones.
