1: yes it can. without H@H voice via wifi will take minutes. With it you will have unlimited use via wifi.
2: I have seen this for skype:

I dont know if anyone has tested it on the 8320 with wifi
3: That depends on how long you have been a customer. What congressional ruling are you refering to? Are you refering to the library of Congress opinion that phone unlocking is exempt from prosecution under the DMCA? Because that is hardly relevent to your situation.
4: I dont know. wifi dun is highly unlikely though. BT will probably work.
5: Depends entirely on your preference. Try both side by side in a store. Better try at an at&t store, tmobile doesent have the 8800 in stores anymore.
