i dont have t-mobile @ home plan

As I understand it, phone use over wifi will count against minutes if you don't subscribe to the tmobile at home service.

Exactly. The 9.99 T-Mobile @ Home plan is needed for the calls to be unlimited and "free".

Just had a conversation with t-mobile today about this. I had been led to believe that the @home plan would give us unlimited calls while using wifi at home but I was told otherwise today. Here's what they told me:

T-mobile has 2 plans -- @home and unlimited hotspot. @home is unlimited calls from a home phone only, unlimited hotspot is unlimited calls using your BB over your home wifi or at any t-mobile hotspot. @home is 9.99/month and unlimited hotspot is also 9.99/month.

From their faq:
"T-Mobile @Home provides unlimited nationwide calling from your home phones 24/7. Just use any standard home phone and plug it into the T-Mobile wireless router with a home phone connection. The wireless router connects over your broadband Internet connection for clear calling."
and

I hadn't realized there are two different plans -- discovered it the hard way by getting the wrong one but at least figured it out within my 14 days to return. It seems a lot of folks find this one confusing.

so the plan wont apply if i go and make calls over someones wifi/non Tmo hotspot network overseas?

There is only 1 cell plan for unlimited calling. The other plan is a VOIP type plan where you plug a regular phone into their router that you have to buy. So the home plan can't really be used on someone else's network unless you bring the router with you.

The 8320 basically doesn't care which wifi it's hooked to as long as it has access and a good enough speed, etc. All it does is act like a cell site as if you were in the US, but it shows UMA instead of EDGE or GSM. It uses minutes unless you have the unlimited plan.

But be clear it is like you are calling from the US, so you can call on UMA from overseas to the US and it is like you're calling from the US to the US. But, for example, if you call the hotel you're staying in, it will be charged as a long distance call from the US to where you are.

The reason it's confusing is that the name used for the home plan is the same or nearly the same as the one used for the cell phone add on for maybe 6 to 9 months. They changed the name last year, but it had already been out for a while so many people remember it by the old name.
