Default New or Refurbished?

How can you tell if the replacement sent is new or refurbished? The phone arrived in a brown box (just a phone no accessories), and the sticker had the infamous 'green' sticker on it.

It states Supplier RIM: 12062009. Nothing received with the phone indicates it is refurbished, and the sticker and mfg date imply it is new.
S/W is listed as 4.7.1.61.

My current phone was Mfgr in October 2009 and did not have a green sticker on the box.

Now, my exising Tour is working great. For a few hours yesterday, the trackball would not move the curser vertically. It worked horizontally. I called Verizon, and after the call, it started to work.

So, should I keep the new phone or keep the old one and return the new one?

Its usually noted on the box? How did you get it? My impression is that its a refurb.

Go to Options, Select About, scroll down to "Refurbished:" It will say N or Y with a date.
